In a controversial move, the government has created the post of executive chairmen in the development committees of two hydropower projects — 600MW Budhi Gandaki and 400MW Nalsyaugad.
The decision taken after amending the Development Committee Formation Order at the behest of Prime Minister Baburam Bhattarai, who also looks after the Ministry of Energy (MoE), has given the entire financial and administrative authority of the projects to the executive chairmen.
The appointment of Laxmi Prasad Devkota and Sher Bahadur Singh as executive chairmen of the development committees of Budhi Gandaki and Nalsyaugad projects respectively, however, contradicts the government policy of appointing project chiefs through open competition.
The Cabinet had endorsed the amended Development Committee Formation Order last week. Earlier, the Cabinet had appointed Devkota and Singh as chairmen, which is largely a ceremonial post.
According to sources, the Prime Minister tabled the amendment proposal to secure his direct intervention in the multi-billion rupee projects. These projects are estimated to cost more than Rs 200 billion.
Singh is not professionally associated with the hydropower sector, while Devkota is a hydro-electric engineer, but does not have experience of developing a hydropower project. Devkota hails from Gorkha, the home district of the Prime Minister, while Singh is a local Maoist leader. A high-level official at the ministry said this is the first time that the entire financial and administrative authority of a project has been given to a single person.
“This is a complete violation of the country’s law,” he said. “Previously, there was no system of appointing executive chairman in the project development committee.”
As per the existing provision, the chief of MoE’s planning division becomes the member of the development committee, while the joint secretary (with technical background) works as the executive director until a chief executive officer is appointed through free competition.
Another ministry official said after the appointment of the executive chairmen, the MoE will have no say in the decision making process in the projects. “Only the Prime Minister will have direct influence in these projects through the chairmen he has appointed,” he said.
He added appointment of such individuals, who do not have relevant experience, as executive chairmen will not only delay the projects, but also encourage financial irregularities. “There will be no influence of experienced ministry officials on the board,” he said.
The amended Development Committee Formation Order has made provision of having joint secretaries at energy, finance and law ministries, NEA’s executive director and two experts as the members of the development committees. The government has appointed Shree Ranjan Lacaul and Sunil Bahadur Malla as members of Budhi Gandaki and Nalsyaugad, respectively, from the Energy ministry. Representatives from the law and finance ministries are yet to be named.
In Budhi Gandaki, former chief of Chilime hydropower project Dambar Bahadur Nepali has been appointed as expert member, while Gyaneshwor Karki and Krishna Sharma have been appointed as expert members in Nalsyaugad.

ऊर्जा मन्त्रालयको समेत कार्यभार सम्हालेका प्रधानमन्त्री बाबुराम भट्टराईले विस्तृत इन्जिनियरिङ अध्ययनका क्रममा रहेका दुई ठूला जलाशययुक्त बूढी गण्डकी र नलसिंगाड जलविद्युत् आयोजनामा प्रत्यक्ष हस्तक्षेप रहने गरी विकास समितिमा कार्यकारी अध्यक्ष बनाएका छन् । उनले तिनीहरूलाई सम्पूर्ण आर्थिक तथा प्रशासनिक अधिकार दिएका छन् ।
प्रधानमन्त्रीले मन्त्रिपरिषद्को पछिल्लो बैठकबाट दुवै आयोजना विकास समिति गठन आदेश संशोधन गरी यसअघि अध्यक्ष मात्र नियुक्त दुवै जनालाई आयोजना प्रमुखसहित सम्पूर्ण आर्थिक तथा प्रशासनिक अधिकार दिने गरी कार्यकारी बनाएको जानकारी ऊर्जा मन्त्रालयका अधिकारीले दिएका छन् ।
खुला प्रतिस्पर्धाबाट आयोजना प्रमुख या प्रमुख कार्यकारी अधिकृत नियुक्त गर्ने सरकारको निर्णयविपरीत प्रधानमन्त्रीले २ खर्बभन्दा बढी लागतका यी दुई आयोजनामा आफ्ना गृह जिल्लावासी र कार्यकर्तालाई कार्यकारी अध्यक्ष बनाएका हुन् । यसअघि प्रधानमन्त्रीले मन्त्रिपरिषद्बाट निर्णय गराई ६ सय मेगावाटको बूढी गण्डकीको विकास समितिमा गृह जिल्लाबासी लक्ष्मीप्रसाद देवकोटा र ४ सय मेगावाट क्षमताको नलसिंगाड आयोजना विकास समितिको अध्यक्षमा माओवादी पार्टीमा आबद्ध शिक्षक शेरबहादुर शाहीलाई नियुक्त गरेका थिए । प्रधानमन्त्रीले मन्त्रिपरिषद्बाट विकास समिति गठन आदेश संशोधन गरी दुवै जनालाई कार्यकारी अध्यक्ष बनाएका हुन् । यसअघि खुला प्रतिस्पर्धाबाट आयोजना प्रमुख या प्रमुख कार्यकारी अधिकृत नियुक्त गर्न दुवै आयोजना विकास समितिमा अध्यक्ष मात्र नियुक्त गरिएको हो ।
‘विकास समिति गठन आदेश संशोधन गरी दुवै जना कार्यकारी अध्यक्षलाई आयोजना प्रमुखसहित सम्पूर्ण प्रशासनिक तथा आर्थिक अधिकार दिइएको छ । यसअघि आयोजना विकास समितिका कार्यकारी अध्यक्ष राखिने परम्परा थिएन,’ ऊर्जाका एक अधिकारीले भने । मस्र्याङ्दी जलविद्युत् आयोजना निर्माण गर्दा गठित विकास समितिमा तत्कालीन जलस्रोत सचिव अध्यक्ष थिए । यसअघि खुला प्रतिस्पर्धाबाट प्रमुख कार्यकारी अधिकृत नियुक्त नभएसम्म मन्त्रालयले तोकेको प्राविधिक सहसचिव कार्यकारी निर्देशक रहने व्यवस्था थियो ।
प्रधानमन्त्रीले अनुभवहीन देवकोटा र शाहीलाई कार्यकारी अध्यक्ष बनाउँदा विकास समिति गठन आदेशलाई उल्लंघन गरेको ऊर्जा मन्त्रालयका अधिकारीले जानकारी दिए । गठन आदेशमा विद्युत् आयोजना निर्माणमा १० वर्षको अनुभव भएको व्यक्ति कार्यकारी अध्यक्ष हुने व्यवस्था छ । दुवै कार्यकारी अध्यक्ष जलविद्युत् क्षेत्रमा कार्यरत व्यक्ति होइनन् ।
शाही यसअघि शिक्षक थिए । देवकोटा हाइड्रोलिक इन्जिनियर भए पनि विद्युत् आयोजना बनाएको अनुभव छैन । देवकोटा यसअघि काठमाडौं उपत्यका खानेपानी लिमिटेडको अध्यक्ष र योजना आयोगको सदस्य थिए ।
कार्यकारी अध्यक्षलाई कार्यालयमा पूर्ण समय रही आयोजनामा कर्मचारी नियुक्त गर्ने, चेक काट्नेसहितको सम्पूर्ण कार्यकारी अधिकार हुने छ । ‘प्रधानमन्त्री भट्टराईबाट नियुक्त दुवै जना कार्यकारी अध्यक्ष दुवै आयोजनामा अधिकार सम्पन्न आयोजना प्रमुख हुने छन् । उनीहरूमार्फत दुवै आयोजनामा प्रधानमन्त्रीको प्रत्यक्ष हालीमुहाली चल्ने छ,’ ऊर्जा मन्त्रालयका एक अधिकारीले भने, ‘दुवै आयोजनामा मन्त्रालय र प्राधिकरणका अनुभवी अधिकारीको कुनै अधिकार रहने छैन ।’ विकास समितिमा अनुभवहीन व्यक्तिलाई कार्यकारी अध्यक्ष बनाइएको र मन्त्रालय, विभाग तथा प्राधिकरणका अनुभवी अधिकारीलाई आयोजनामा खासै भूमिका नदिइएकाले बूढी गण्डकी र नलसिंगाड निर्माण हुनेमा आशंका बढेको सम्बद्ध अधिकारीले बताए ।
संशोधित विकास समिति गठन आदेशमा कार्यकारी अध्यक्षसहित ऊर्जा, अर्थ र कानुन मन्त्रालयका सहसचिव, विद्युत् प्राधिकरणका कार्यकारी निर्देशक रामेश्वर यादवलाई सदस्य र दुई जना विज्ञ राख्ने व्यवस्था गरिएको छ । ऊर्जा मन्त्रालयका दुई सहसचिवमध्ये श्रीरञ्जन लाकौललाई बूढी गण्डकी र सुनिलबहादुर मल्ललाई नलसिंगाड विकास समितिको सदस्य नियुक्त गरिएको छ । विकास समिति सदस्यका लागि अर्थ र कानुन मन्त्रालयका सहसचिव तोकिन बाँकी छ । संशोधित गठन आदेशमा वन र वातावरण मन्त्रालयका सहसचिव राख्ने व्यवस्था हटाइएको छ । आयोजना निर्माण गर्दा यसअघि वन र वातावरण मन्त्रालयसित समन्वय मिलाउन ती मन्त्रालयका एक/एक सहसचिव सदस्य राख्ने व्यवस्था थियो ।
बूढी गण्डकीमा चिलिमे आयोजनाका पूर्वप्रमुख डम्बरबहादुर नेपालीलाई विज्ञ नियुक्ति गरिएको छ । अर्को एक जना विज्ञ नियुक्त हुन बाँकी छ । नलसिंगाडमा भने विज्ञबाट ज्ञानेश्वर कार्की र कृष्ण शर्मालाई सदस्य नियुक्ति गरिएको छ ।
